All vehicle operators on Georgia’s interstate highways, county, city and state roads, are required to obey the Uniform Rules of the Road. These rules are primarily contained in Title 40 of the Official Code of Georgia. Rule violations often involve O.C.G.A. § 40-6-49, “following too closely,” O.C.G.A. § 40-6-181, “speeding,” and O.C.G.A. § 40-6-390, “reckless driving.” A violation of one or more rules of the road constitutes a breach of a legal duty, and may give rise to a claim against the at-fault party for negligence.
Victims of a vehicle accident must prove that the other driver was negligent by breaching their legal duty to follow the rules of the road, and that the violation resulted in damages (i.e. injuries). Finally, a lawyer has to be able to prove that the damages or injuries claimed were “caused” by the negligence of the other driver. Often, during litigation, the lawyer for the at-fault party will claim that the injuries claimed were not the result of the car wreck but, instead, were the result of some preexisting injury or condition. This situation often occurs in cases involving neck or back injuries in which the injured party may have experienced prior neck or back pain or degenerative disc disease, or aging of the spine. In most cases, we are able to defeat such defense arguments through medical records and/or testimony from one or more of the injured party’s doctors.
